man thats a fucked situation. from the perpetrator’s pov, he’s done no wrong. from the victim and the laws pov, he is at the least partly responsible for what happened, if not fully responsible. i don’t think theres a right answer, cuz if you pardon him or lessen his punishment at all, the victim will feel wronged, but if you give him like 6 years in prison, then he would be pissed cuz he neither intended nor wanted to commit the crime
